The Instrument aims to establish a core of provisions that protect the public interest in a mandatory way for future Contracting Parties, which remain free, however, to go beyond the set of permitted uses provided for in the Instrument. The approach adopted counteracts the traditional "minimum protection" approach of international patent law. Among other things, this approach helps Contracting Parties to address the political pressure that notoriously exists in international negotiations, especially in the context of bilateral or regional agreements.
In particular, the work focused on the second part, which deals with the clauses, the substantive law provisions to which the parties will be committed in terms of public interest enforcement in patent law. This part is divided into different sections: patentability, scope, permitted uses, dysfunctional uses, enforcement and jurisdiction. Each of these sections is further divided into chapters dealing with different points of patent law where states are obliged to ensure the public interest.
