Workshop on trade secrets and test data protection

As a new line of research, the workshop aimed to make the first approach to the issues of trade secrets and test data protection in Latin America. To start the discussion, the SIPLA team elaborated a questionnaire consisting of the main points to be analysed on the subject. 

The workshop also included a presentation by Luc Desaunettes, a specialist in trade secrets from the University of Louvain, who introduced the main aspects of this intellectual property right in the European Union. 

The objective of the Project, in this first instance, is to conduct a comparative study of the regulatory and jurisprudential situation of trade secrets and test data in Latin America. To this end, it is proposed to carry out a questionnaire containing the main aspects of trade secrets and how case law has interpreted the scope of this right. It also seeks to establish the know-how treatment in the legislation under analysis. About the countries under study, it is proposed to use the key countries of the initiative.
